A MAN put himself in breach of a restraining order by going to help his daughter following the death of her mother who was his ex-partner.

Blackburn magistrates heard Ian Gibbons was banned from having any contact with his ex-partner or their daughter and attending the deceased’s woman’s home on Snowden Avenue.

Police were called after receiving a report of an ongoing incident involving Gibbons and his daughter.

Gibbons, 55, of Gretna Walk, Blackburn, pleaded guilty to breach of a restraining order. He was given an eight-week suspended prison term with £85 costs.

Sameena Chaudhry, prosecuting, said when police arrived Gibbons became very agitated and a check on the police computer revealed the restraining order in respect of his daughter and his ex-partner.

“He said he was there to assist his daughter following the passing of her mother,” said Miss Chaudhry.

Jonathan Taylor, defending, said his client had been helping to sort out his ex-partner’s effects and supporting his daughter.

“The house is going to be emptied soon and his daughter is living with her boyfriend in Brierfield so there is little chance of a repeat,” said Mr Taylor.

“If his daughter wants to have the order lifted she will have to go through the proper channels.”
